Article 1
Acceptance of the Terms of Use
These terms of use (hereinafter "Terms") set out the conditions for accessing and using the Site by any person visiting it (hereinafter "the User").
By connecting to the Site, the User is deemed to know and accept these Terms. They apply in conjunction with the Privacy Policy, link to which is accessible in the Site footer.
The Company reserves the right to modify these Terms at any time. The applicable version is the one in force on the Site at the date of the User's connection. The invalidity of any clause shall not affect the validity of the Terms as a whole.
Article 2
Access to and Use of the Site
2.1 Public site access
The Company makes the Site available to Users at https://contalto.com in order to inform them of its activities, Services and publications under the Contalto brand. The Site presents in particular:
- the Contalto content-to-commerce competitive intelligence platform (subscriptions);
- Contalto Intelligence Reports — periodic or one-off analytical publications on branded content, sponsored events and
commerce content markets;
- the Contalto newsletter — a free publication distributing market analysis and trends;
- advisory services offered by DM Squared.
The Company undertakes to use its best efforts to ensure continuous access to and operation of the Site. Its liability may not be engaged in the event of temporary unavailability due to maintenance operations, events beyond its control or cases of force majeure. The Company will notify Users in advance of any foreseeable unavailability.
The User is solely responsible for their use of the Site and of the information and data it contains. The User undertakes to use the Site and its content appropriately and to refrain from any conduct likely to cause harm to the Company, third parties or themselves.
2.2 Contalto platform access (private area)
The Company's Clients and their Authorised Users are provided with login credentials enabling them to access the Contalto web application at https://app.contalto.com. The conditions of use of this private area are governed by the General Terms and Conditions of Services Contalto (current version available on the Site) and by the Specific Conditions entered into between the Company and the Client.
Any unauthorised access to this private area may give rise to civil and criminal liability on the part of the person responsible.
Article 3
Personal Data and Cookies
3.1 Processing of personal data
Users are invited to read the Company's Privacy Policy, available on the Site, which describes all personal data processing operations carried out by the Company, including information relating to the use of HubSpot as a CRM tool and data transfers to the United States under the EU-US Data Privacy Framework.
3.2 Cookies and trackers
The Site uses cookies and trackers. On the first visit, a cookie management banner enables the User to accept or refuse non-strictly-necessary cookies by category. The User may modify their preferences at any time via the 'Cookie settings' link accessible in the Site footer.

All elements constituting the Site — systems, software, structures, infrastructure, databases, content of any nature (texts, images, visuals, logos, trademarks, domain name, etc.) — as well as the Contalto brand, Derived Data, Intelligence Reports and Proprietary Taxonomy operated by the Company are protected by intellectual property law and belong exclusively to DM Squared SAS or are the subject of licences in its favour.
The content of the Site is intended exclusively for the User's information and personal use, and the User benefits from a private, non-collective and non-exclusive right of use. Unless expressly and prior authorisation is given by the Company, any reproduction, dissemination, representation, adaptation or commercial exploitation of this content is strictly prohibited and may engage the civil and criminal liability of the perpetrator.
The trademark "Contalto" and the Contalto logo are registered trademarks of DM Squared SAS. Any unauthorised use of these trademarks constitutes an infringement that may be subject to legal proceedings.

Limitation of Liability
The Site is provided as is. The Company endeavours to ensure the accuracy and currency of information published on the Site but cannot guarantee its completeness, accuracy or timeliness at all times. Information presented on the Site is of a general nature and does not constitute professional advice.
The Company shall not be liable for any direct or indirect damage resulting from access to or use of the Site, including inaccessibility, data loss or any damage resulting from the presence of viruses or technologically harmful elements capable of infecting the User's equipment.

These Terms are governed by French law. In the event of a dispute relating to their validity, interpretation or performance, French courts shall have jurisdiction regardless of the location and nationality of the User.
This jurisdiction clause applies to these Terms and to the relationship between the Company and Site visitors. Contractual relationships between the Company and its professional Clients are governed by the General Terms and Conditions of Services Contalto and the applicable Specific Conditions, which may provide for specific dispute resolution arrangements.
