Hereinafter referred to as “the Company”.

The purpose of these Terms of Use, hereinafter referred to as “the Terms”, is to set the terms and conditions of use of the Site.
These Terms apply exclusively between the Company and any person visiting the Site, hereinafter referred to as “the User”.
The Site is hosted by WIX and was created by DM Squared SAS.

Article 1. Acceptance of the Terms and Conditions of Use

The User is presumed to know and accept these Terms solely because of his/her connection to the Site. They apply in conjunction with the Legal Notices, the General Terms and Conditions, the Privacy Policy and any variation or extension of the Site on existing or future social and/or community networks.

The Company reserves the right to modify and supplement these Terms at any time.
​
The version of the Terms applicable is the one in force on the Site on the date of the User’s connection to the Site.

It is agreed that the invalidity of a contractual clause does not result in the invalidity of all the Terms.

Article 2. Access to and use of the Site

2.1 Access to the public site

In order to inform the User of its activity and the services it offers, the Company makes available to the User the Site accessible at the address https://contalto.com

The Company undertakes to make its best efforts to ensure that access to and operation of the Site are uninterrupted. However, the Company cannot be held liable in the event of temporary unavailability of the Site (i) in the event of maintenance of the Site or the server on which it is hosted, (ii) in the event of events beyond its control and (iii) due to force majeure. The Company will inform the User in advance of the unavailability if the event causing the unavailability is foreseeable.

As the publisher of the Site, the Company reserves the right to suspend access to the Site (i) in the event of loss, theft and/or use of the User’s identification data of which the User has informed it, (ii) in the event of use not in accordance with the provisions hereof, (iii) in the event of maintenance operations. Its liability cannot be engaged because of these interruptions and the consequences that may result for the User.
The Company also reserves the right to insert or authorize any third party to insert advertising, promotional and/or sponsorship messages in any area of the Site.

The User is solely responsible for the use he/she makes of the Site and the use he/she makes of the information and data it contains. In particular, the User undertakes to use the Site and its content properly and refrains from any conduct that may harm the Company, a third party or him/herself, in particular by misusing the content of the Site or violating the provisions of Article 5. Intellectual property of these Terms.

All hardware and software necessary to access the Site remain the sole responsibility of the User. It is the User’s responsibility to take all appropriate measures to protect his/her own data and/or software from contamination by possible viruses.

2.2 Access to the private site

The Company’s Clients and their agents are provided with an identifier and password enabling them to connect to the private area of the Site, exclusively reserved for Clients.

The conditions of use of the private part of the site are governed by the General Terms and Conditions.

Any unauthorized intrusion into this private space may result in prosecution.

Article 6. Applicable law – Competent jurisdiction

These general terms and conditions of use are governed by French law.
In the event of a conflict between the French version of the CGU and any translations made, the French version (copied below) shall prevail.
In the event of a dispute concerning in particular the validity, interpretation and/or execution of these conditions, the French courts shall have jurisdiction, regardless of the location and nationality of the User.
